Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a.On or about August 1, 2011, the 23 feet deep excavation did not have an adequate protective system, exposing an employee to a collapse hazard. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED. One feasible and acceptable abatement method would b e to slope the walls of the excavation.
