Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from improperly working parking brakes on a delivery truck: a)1301 Boll Weevil Circle, Enterprise AL 36330; On or about May 20, 2011 to employees were exposed to struck by hazards in that the employer did not provide training on the type of truck in question on how to operate or test the parking brake on delivery trucks. Feasible means of abatement inclued, but are not limited to: a) Train all current truck operators within 45 days, and all new truck operators prior to assignment on the proper procedures for inspecting and evaluating truck controls and instrumentation to include parking brake. b) Establish work rule(s) to ensure that the daily DVR (Driver's Vehicle Inspection Report) procedures are effectively communicated to truck drivers. c) Establish methods for discovering and correcting violations of the work rule (i.e.: not performing the daily inspection properly).
