50-9-5.A NMSA 1978: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to fall hazards hazards when working from a wood pallet elevated on the forks of a powered industrial truck: On or about April 10, 2011, an employee was exposed to falls from a wooden pallet raised to a height of 10 feet on the forks of a walkie-stacker in the stockroom, which may result in serious traumatic injuries. One feasible and acceptable method of abatement, among others, is to ensure that a policy is in place, employee work practices reviewed, and appropriate disciplinary action enforced which prevents employees from standing on raised pallets to unload materials.
