Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) 1231 US 206, Shamong, NJ 08088: On or about April 4, 2011, employees were exposed to struck by hazards while felling and removing 30ft tall trees. A chain saw operator was fatally crushed by a tree he was felling. AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO: 1) Plan an escape route before cutting any standing tree in accordance with ANSI Z133.1-2006, Section 8.5.4. 2) Use notches and back cuts to enable the chain-saw operator to safely begin the cut, control the tree or trunk and have freedom of movement for escape in accordance with ANSI Z133.1-2006, Section 8.5.15. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
