Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 07/11/2011, at 220 NW 2nd Street, Miami, Florida, an employee was exposed to a fall hazard of over 49 feet to the ground level while leaning against a continuous wire rope fall protection system that was equipped with regular nut eyebolts that would be side-loaded if force was to be exerted on the wire rope guardrail. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the specifications of the supplier, Miami Cordage/Florida Wire and Rigging Works, which states that "regular nut eyebolts are designed for straight line pull applications only." Additionally, as stated by The Crosby Group Incorporated, in their Forge Eyebolt Warnings and Application Instructions under its Assembly Safety section, "Never use regular nut eyebolts for angular lift. Always use shoulder nut eyebolts (or machinery eyebolts) for angular lifts." PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
