Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to electrical hazards: On or about 3/09/2011, at 9909 Pacific Way Road, Eller Block 7-4, row three, in Immokalee, Florida, citrus pickers, were exposed to electrical hazards when harvesting oranges and using aluminum ladders underneath distribution lines. Among other methods, a feasible and acceptable means of abatement is to comply with Paragraph D, Approach Distances for Unqualified Persons, Table 130.2(C) Approach Boundaries to Energized Electrical Conductors, Article 130 Work Involving Electrical Hazards, of NFPA 70E, Standard for Electrical Safety in the Workplace, 2009 Edition; and to maintain a minimum distance of 10 feet between a conductive object and the overhead 14.4 kilovolt distribution lines.
