Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, an employee was exposed to struck-by hazards and did not utilize and wear the seatbelt while operating an all terrain forklift (telehandler). (a)East Side of Construction Site - On or about February 9, 2012 an employee was exposed to struck-by hazards while operating a rough terrain forklift equipped with a ROPS System. The employee was not protected by wearing the seatbelt provided in the cab of the vehicle. Among others, a feasible and useful abatement method to correct this hazard would be to utilize and wear the installed seatbelt in accordance with the current version of American National Standard Institute (ANSI) B56.1, "Safety Standard for Powered Industrial Trucks," and American Society of Mechanical Engineers (ASME) B56.1-2000, "Safety Standard for Low Lift and High Lift Trucks."
