Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees, in that, employees were exposed to hazard of being struck by a rotating abrasive wheel. (a)Maintenance Area - On or about November 18, 2011 an 8 inch Jet bench grinder did not have an adjustable tongue guard installed. (b)Maintenance Area - On or about November 18, 2011 an 8 inch Jet bench grinder did not have the tool rest adjusted to within 1/16" of the grinding wheel. Among other methods, one feasible and acceptable abatement method to correct the hazards would be to install a properly adjusted tool rest and adjustable tongue guard.
