Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards due to the Below-the-Hook lifting device was not marked and the hoists were overloaded: (a)On or about June 14, 2011, in the assembly area, the Below-the-Hook lifting devices weighing 740 lbs and used to lift rubber sheets being assembled, were not marked or had an inspection plate which listed the following: - Rated load - Manufacturer's name and address (b)On or about June 14, 2011, in the assembly area, the 1/2 ton capacity hoists used to raise the rubber sheets were overloaded. Each hoist had up to 1450 lbs load. Among others, one feasible and useful abatement method to correct these hazards is to; a)Mark or affix an identification plate to the devices which includes the information required and perform inspections as required by ASMS B30.20-2006. b)Replace the 1/2 ton hoists with hoists having a load capacity equal to or greater than the loads being lifted as required by ASMS B30.16-2007.
