Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee operating forklift was exposed to a crushing hazards because the employee was not wearing a seatbelt. (a)Facility, Main Floor - On or about April 25, 2011 an employee was exposed to crushing hazards while operating a forklift. The employer did not enforce the use of a seatbelt which was supplied by the forklift manufacturer. Among others, one feasible and acceptable method of abatement would be to require the employee to wear and the employer to enforce the use of the seatbelt for all operators while operating forklifts in the facility as required by ANSI/ASME B56.1 - 2005. ANSI/ASME B56.1 - 2005 paragraph 5.3.19 states, "An active operator protection device or system, when provided, shall be used."
