A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to their employees, in that the employer did not ensure that restraining devices (i.e., seat belts) were installed on each forklift to restrain the operator in the event of a rollover: (a) North side of Self-Storage Building C: One employee was operating a Clark forklift, Model GPS25C, Serial number BP138MC-186-5533A, which was not equipped with a seat belt to restrain the operator in the event of a rollover.
