Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On and before December 20, 2010, employees were exposed to being struck by railroad equipment while utilizing an active CSX railroad bridge trestle system as a means of access / egress across a partially frozen creek channel in order to reach their work area, an electric utility right of way, for the purpose of clearing brush and other vegetation. Among other methods one feasible and acceptable method to correct this hazard would be to follow the Asplundh policy as it relates to working on and or near Railroad Operations contained in Basic Tasks 2 (10) and coordinate permission with proper railroad authorities to encroach upon railroad properties.
