Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to caught between, struck by, and/or fall hazards when riding the grapple attachment of an excavator: a) On or about May 3, 2011, at a jobsite located at 4044 W. Jackson Blvd., Chicago, IL - employees riding the sorting grapple attachment of a demolition high reach excavator to access the roof of a building were exposed to fall hazards of approximately twenty five (25) feet. Among other, feasible and acceptable methods of abatement would be to not allow employees to ride the attachment of an excavator, or any other similar equipment as described in the Patten/Cat Operation and Maintenance Manual for G315, G320 and G330 Demolition and Sorting Grapples, and the Equipment Caterpillar's Operation and Maintenance Manual for Excavators 320B, 322B, 325B, 330B and 345B.
