Text For Citation: 01 Item/Group: 001 Hazard: UNCLASS
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to an oxygen-deficient atmosphere associated with nitrogen: On or about May 5, 2011, in the facility, employees were not adequately protected against the release of nitrogen and an oxygen deficient atmosphere in that: a. The process room where employees operated equipment (hamburger making machine, spiral freezer) that used nitrogen was not provided with a gas detection and alarm system to warn employees of a release of nitrogen in excess of the allowable limit (lowering the oxygen level below 19.5%). Among other feasible and acceptable methods to control these hazards would be to comply with the guidelines outlined in the Compressed Gas Association, Inc. Safety Bulletin 2, "Oxygen Deficient Atmospheres" 2007, ANSI/AIHA Z9.2-2001 "Fundamentals Governing the Design and Operation of Local Exhaust Ventilation Systems" and ANSI/ASHRAE Standard 15-2007 "Safety Standard for Refrigeration Systems".
