Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while hoisting material: (a)In the Secondary Area, the rail system used for the CM Valustar #3031, 1/4 ton underhung hoist, had bolts missing on the brace support, rail and leg. Employees transporting steel cylinders to perform secondary work and to package the cylinders in wooden containers were exposed to struck-by hazards. Among other methods, one feasible and acceptable method to correct theses hazard is to adhere to the guidelines in the American Society of Mechanical Engineers (ASME) B30.11 2010, Monorails and Underhung Cranes, Chapter 11-2 Inspection and Testing and Chapter 11-4 Maintenance and Testing as applicable. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
