Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and run-over hazards: a)Loading dock: On or about November 8, 2010, and at times prior, the employer did not ensure that employees acting as "spotters" were provided high-visibility vests (reflective vests) to reduce the risk of being struck-by or run over by Ottawa trucks attached to trailers. The loading dock is covered, creating limited light conditions and shadowed areas. Among others, one feasible abatement method is to provide the spotters with reflective vests and require them to wear them when spotting trucks in the loading dock.
