Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a) On or about October 14, 2010 and times prior, an employee working at 2333 San Juan Drive in Lake City, Colorado operated a backhoe without wearing a seat belt. The operator was fatally injured after the backhoe rolled down an embankment and ejected him. One feasible and acceptable abatement method to correct this hazard would be to enforce the manufacturer's procedures for seat belt use.
