Text For Citation: 01 Item/Group: 001 Hazard: CONFINED
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not protected from the hazards such as, but not limited to, atmospheric contaminants and oxygen deficiency, while working in a manhole approximately 12'9" deep. On or about 12/30/2010 an employee of Mark IV Construction was transported to the hospital for evaluation after becoming unresponsive while working in a manhole in front of 12 Hunters Lane in Trumbull, CT. Among other methods, one feasible and acceptable means of abatement is implementation of the elements required by the American National Standards Institute (ANSI)/American Society of Safety Engineers (ASSE) Standard Z117.1 2009, Safety Requirements for Confined Space. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date of this citation, the employer must submit documentation of compliance with the standard, including describing the steps taken to ensure that a confined space entry program that complies with ANSI/ASSE Standard Z117.1-2009, has been implemented for any and all confined space entries by employees
