Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of not performing periodic inspection of energy control procedures to ensure that the requirements of procedures are being followed to prevent the hazards of being electrocuted, struck-by and caught-in by the rail, train and other components of the Automated People Mover (APM) system which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about October 26, 2010, where periodic inspections were not conducted at least annually for employees performing service, maintenance and other work tasks on the APM guide-way. Among other feasible methods to correct the identified hazard, one method would be to conduct periodic inspections at least annually. Disclaimers: 1.You are not limited to the abatement methods suggested above. 2.The methods explained are general and may not be effective in all cases. 3.The employer is responsible for selecting and carrying out an appropriate method of abatement. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that period inspection are conducted at least annually. IN THE ALTERNATIVE: 29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: The employer does not conduct a periodic inspection of energy control procedures at least annually to ensure that the procedure and the requirements of this standard are being followed. This violation occurred on or about October 26, 2010 and times prior to, on the Automated People Mover (APM) system, where periodic inspections were not conducted at least annually for employees performing service and/or maintenance tasks on the Automated People Mover (APM) guide-way to ensure that the procedures and the requirements of this standard are being followed. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that periodic inspections of the energy control procedures are conducted at leastannually to ensure that the procedures and the requirements of this standard are being followed.
