North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards: a)job site - where the employer failed to recognize the hazards associated with the removal of a 70-foot high, approximately 21-inch diameter dead maple tree. The employer failed to remove all limbs to a height and width sufficient to allow the tree to be cut without striking employees. Feasible and acceptable abatement method, among others, to correct this hazard would be to: (1) keep employee(s) from working directly under dead tree limbs, (2) use aerial lifts to remove dead trees.
