Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer does not furnish employment and a place of employment which are free from recogn ized hazards that are causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees are exposed to dust expl osion, deflagration, and other fire hazards because of the improper design and maintenance of dust collec tion systems: Employees in M1 are exposed to fire and explosion hazards while pr ocessing Class II, combustible dusts, and the following deficiencies are observe d: Starch and potato base are processed and the employer does not ensure the dus t collector is equipped with explosion prevention by containment, suppression, i nerting, or explosion venting. NFPA Standard 61 - 2006, Standard for the Prevent ion of Fires and Dust Explosions in Agricultural and Food Processing Facilities: Section 10.4.2: "Dust collectors and filters used for grinders or hammermills s hall be located outside of buildings and shall be protected in accordance with S ection 6.3" Among other methods, feasible abatement methods to correct this haza rd is to comply with the guidelines of NFPA Standard 61 - 2006, Standard for the Preventi on of Fires and Dust Explosions in Agricultural and Food Processing Facilities, including, but not limited to: a) Equip the dust collector with containment, sup pression, inerting, or explosion venting; b) Discontinue the processing of combu stible materials ***ALL FEED PROCESSING AND PACKAGING, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALE NT STANDARD 5(a)(1) UNDER INSPECTION NUMBER 312886237, CITATION 01, ITEM 001, IS SUED ON OCTOBER 5, 2009, AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 22, 2009, WITH RESPECT TO THE WORKSITE LOCATED AT 717 W. DIVISION STREET, GALVA, ILLINOIS. *** Pursuant to 29 CFR 1903.19, the employer must submit documents describing th e steps it is taking, detailing appropriate engineering controls that have been implemented to eliminate fire and explosion hazards, to ensure compliance. ***Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)* **
