Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Title 40.1-51.1(a) Code of Virginia: The employer, Brown's Prestige Car Sales and Leasing Inc., did not furnish to each employee safe employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees. On August 10th, 2010 at 10570 Fairfax Blvd., Fairfax VA 22030, an employee of Brown's Prestige Car Sales and Leasing Inc. utilized a 12 foot, orange, Werner fiberglass step ladder to gain access to storage materials on the roof of an office and hallway in the repair shop. The storage was located 8 feet, 7 inches above the floor. While the ladder was in use by the employee it was closed and leaning against the roof, exposing the employee to fall hazards. The employee was instructed to remove the materials by his supervisor. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to use the ladder in accordance with American National Standards Institute (ANSI) A14.5-1982, Safety Requirements for Portable Reinforced Plastic Ladders, Section 9.3.1.2 which provides as follows: "Self-supporting ladders shall not be used as single ladders or in the partially closed position."
