Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer does not furnish to each of his employees a place of employment which are free from recognized hazards that may cause death or serious physical harm in that employees were exposed to the hazard of falling from an elevation: On or about June 1, 2011, employee(s) were exposed to the hazard of falling from an elevation during tree trimming operations. The employer did not ensure that employee(s) cutting limbs were protected from falling approximately 15 feet to the ground level. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure personnel are secured by the use of adequate fall protection as stipulated by ANSI Z133.1, Aboricultural Operations - Safety Requirements, chapter 8, paragraph 8.19.1. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to establish, communicate, and implement written procedures to ensure that personnel engaged in tree trimming operations are protected from falling.
