Text For Citation: 01 Item/Group: 001 Hazard: UNCLASS
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious phyical harm to employees in that employees were exposed to the hazard of fire. On or about 05/22/11, the employer did not ensure that leased vehicles operated by drivers were inspected properly to ensure that safety recalls by the manufacturer have been addressed. A 2007 Dodge Ram 3500 VIN 3D6WG46A57G776802, was subject to a recall (NHTSA recall notice #40242) due to fires developing involving the EGR. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to ensure that vehicle recalls are addressed during quarterly vehicle inspections conducted by the employer on all their leased vehicles.
