29 CFR 1910.106(b)(2)(vii)(c)(3): The employer did not ensure that where protect ion of adjoining property or waterways is accomplished by retaining the liquid aroun d the tank by means of a dike, the volume of the diked area did not comply with the following requirement - Walls of the diked area were not of earth, steel, co ncrete or solid masonry designed to be liquid tight and to withstand a full hydr ostatic head: The employer does not ensure that the walls of the diked areas are of earth, steel, concrete or solid masonry designed to be liquid tight and to w ithstand a full hydrostatic head. a) This violation was observed on or about Nov ember 18, 2010 in the Utility Pumphouse Area of Lion Copolymer - Baton Rouge, wh en the diked area around the oil knockout drum 69-V-30 was observed to have a se ction of concrete missing, making it incapable of containing the contents of the tank, should a leak or rupture occur. This exposed employees to fire and explos ion hazards. Pursuant to 29 CFR 1903.19(d), within 10 calendar days of the date of this citat ion, the employer must submit documentation showing that it is in compliance wit h the standard, including describing the steps it is taking to assure the second ary containment dikes are liquid tight and will withstand a full hydrostatic hea d.
