Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about September 9, 2010, at the establishment located at 2511 West 7th Street in Little Rock, Arkansas, Interior Door Storage area, employee operating and using the Nissan Optimum 50 forklift to transport doors for assembling did not utilize the seat belt provided on the forklift. This condition exposed the employee to tip over hazards. Feasible means of abatement would be to ensure the usage of seat belts, communicate the usage to employees and establish a disciplinary policy for violators.
