Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling equipment which was not adequately braced or supported while the equipment was being fabricated. a) On 7/7/2010 a Renovator Frame was being fabricated at the facility. The frame was lifted and positioned upright on its side so that an employee could perform welding on the bottom portion of the frame. The frame was not adequately supported in the upright position. The frame fell over causing fatal injuries to the employee that had been performing the welding. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to develop and implement specific procedures to ensure that equipment being fabricated is positively secured in a manner that will prevent movement or falling. The specific procedures must be clearly communicated to employees and the use of the specific procedures must be strictly enforced.
