North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a falling vehicle in the event the lift failed: a)facility - employees used a Rotary vehicle lift, Model SPOA7-200, Serial Number ALW98DO473, 7000 pound capacity, to inspect and repair vehicles without performing the daily and periodic (including annual operational / lift capacity) inspections as required by the manufacturer's instructions and / or ANSI/ALI-2000, Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance, referenced in the manufacturer's Operation & Maintenance Manual. b)facility - employees used a Chief EZ Liner S21 System to pull / straighten frames without performing the daily and periodic (including annual operational / lift capacity) inspections as required by the manufacturer's instructions. ABATEMENT NOTE: In addition to inspections, operator training requirements are referenced as follows, a) Rotary lift - Operations & Maintenance Manual for Model SPOA7, June 2005, p. 3 - "The Owner/Employer shall ensure that lift operators are qualified and that they are trained in the safe use and operationof the lift using, 1) manufacturer's operating instructions; 2) ALI/SMO1-1, ALI Lifting it Right safety manual; ALI/ST-90 ALI Safety Tips card; ANSI/ALI ALOIM-2000, American National Standard for Automotive Lifts-Safety Requirements for Operation, Inspection and Maintenance; 3) ALI/WL Series, ALI Uniform Warning Label Decals/Placards; and in the case of frame engaging lifts, 4) ALI/LP-Guide, Vehicle Lifting Points/Quick Refernece Guide for Frame Engaging Lifts." b) Chief EZ Liner - Owner's Manual for EZ Liner II, EZ Liner Classic and EZ Liner S21, 1996, p. 1, Important #4. "Persons operating EZ Liner repair system must be at least 18 years of age, must be trained in operation of EZ Liner system, and must have demonstrated their qualifications to the employer. They must also be specifically assigned to operate the EZ liner system by the employer and this assignment must be made in writing."t
