Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to "crushing" injuries associated with operating a forklift without seat belts: a)Noffsinger Manufacturing Company, Inc. 500 Sixth Avenue, Greeley, CO: On or about November 18, 2010, the Nissan (Enduro 30) forklift was not equipped with seat belts. Condition exposed operator(s) to serious injury from overturning and/or falling out of the truck. Abatement Note: Abatement certification is not required for this item.
