Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by vehicular traffic and construction equipment. (a)Interface Communications Company & 104th Ave. & I-25 Hwy, Northglenn, CO: On or before August 31, 2010, the exposing employer did not ensure that each employee working during the nighttime performing activities within the Temporary Traffic Control (TTC) Workzone was wearing suitable High-Visibility Safety Apparel and Headwear meeting the Performance Class 2 or 3 requirements of the ANSI/ISEA 107-2004 American National Standard. The retroreflective safety apparel shall be designed to clearly identify the wearer as a person. This condition exposed employees to the hazard of being struck-by public moving vehicles travelling approximately 35- 40 mph. (1)The hazard of being struck-by moving vehicles and construction equipment during the nighttime while working within the Temporary Traffic Control Zone without wearing suitable High-Visibility Safety Apparel and Headwear that meets the Performance Class 2 or 3 requirements of the ANSI/ISEA 107- 2004 American National Standard. Among others, one feasible and acceptable abatement method to correct this hazard is to ensure that each employee working in the Temporary Traffic Control (TTC) workzone is equipped with suitable High-Visibility Safety Apparel and Headwear such as those that meet the specifications for reflective materials required in ANSI/ISEA 107-2004 American National Standard. Chapter 6D.- Pedestrian and Worker Safety as delineated in the Manual on Uniform Traffic Control Devices (MUTCD), 2003 Edition (Section 6D.03B Worker Safety Apparel) requires the use of High-Visibility Safety Apparel such as those that meet ANSI/ISEA 107-2004 STANDARD for High- Visibility Safety Apparel for risk exposure Class 2 or 3. A competent person designated by the employer must be responsible for the worker safety plan within the activity area of the job site and must make the selection of the appropriate class of warning garment for the activity and based upon certain conditions. Furthermore, the retroreflective safety apparel shall be designed to clearly identify the wearer as a person by wearing vest and pants during nighttime activity.
