Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: a)Styro-Tech, LLC, 5005 Lima Street, Denver, CO: On or about August 10, 2010, an employee operated a Toyota brand forklift while not wearing a seat belt exposing them to injury in the event of a tip-over or other accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees are trained regarding the hazards associated with not wearing seat belts and to implement an active, effective enforcement policy.
