Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to a struck-by hazard: a. On or about 08/31/10 - shipping area, the one ton HS hoist (underhung) was not marked with the rated load capacity. Among other methods, one feasible and acceptable method to correct this hazard would be to comply with the requirements of the American Society of Mechanical Engineers Standard, ASME B30.11-1998, Monorails and Underhung Cranes, Section 11-1.1.2, Rated Load Markings - Monorails.
