Text For Citation: 01 Item/Group: 001 Hazard: DUST&FUMES
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire/explosion as a result of an ignition of combustible dust by static discharge: a) The employer failed to ensure that bonding and/or grounding was maintained on equipment duct work, dust collector and other articles transporting fugitive grain dust. Employees were exposed to the hazards of a fire/explosion while performing assigned duties involving oil seed mill operations. A sample taken on March 15, 2011 was determined to be a CLASS II explosive dust. Among other methods, one feasible and acceptable abatement method to correct the hazard is to comply with the NATIONAL FIRE PROTECTION ASSOCIATION, NFPA 61 "STANDARD for the PREVENTION of FIRE and DUST EXPLOSION in the Agricultural and Food Processing Facilities,"2002 Edition". The employer shall ensure that all ductwork is bonded and/or grounded to dissipate static electricity in accordance with NFPA 61, section 7.5.1.3. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
