Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. Site: 4901 Glenwood Road Brooklyn, NY On or about 6/29/10. a)Employees working from a Crown picking machine (man lift) were required to use a lanyard that was approximately 9 feet long which is too long to provide adequate fall protection. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to comply with the rules and regulations from The American Society of Mechanical Engineers. Safety Standard For Low Lift And High Lift Trucks, ASME B56.1-2000.Pg 49 Section 7.36 (2) Means for securing an operator (a) Lanyards shall be nylon rope (or equivalent stretch material). The length shall be such that the operator(s) has freedom of movement in his working area but shall be limited to a maximum free-fall of 1,525 mm (5ft) measured from the point of attachment to the operator. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
