Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazard of being struck by falling product/materials which are causing or likely to cause death or serious physical harm to employees: On or about August 27, 2010 and times prior thereto at AmeriCold Logistics, LLC, located at 203 Industrial Blvd., Russellville, Arkansas, employees were performing tasks such as placing and pulling pallets of plastic wrapped boxes onto and off of push back carts, conducting inventory control activities and operating double reach lifts in the area. During such activities, a pallet fell from a rack and struck an employee. Among other feasible methods to correct the identified hazard would be the following: Develop and implement a program to locate carts that do not roll forward and pallets that are damaged, extend over the edge of the rack, or are not placed on carts correctly and immediately take corrective action to eliminate the hazard. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to establish, communicate, and implement written procedures to ensure that the above hazard is properly abated.y
