Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a falling tree: a) Worksites such as, but not limited to 210 Emmans Road, Flanders, NJ Employees, not involved in the felling operation, were exposed to being struck by a falling tree and were not removed from the fell pattern of the tree before the back cut was made. Violation occurred on or about 7/19/10. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO: 1. Direct and train all employees, not involved in the removal operation, to stand clear beyond the length of the fell pattern of the tree when cutting begins, in accordance with ANSI Z133.1- 2006, Section 8.5.3. 2. The cutter must confirm, either though visual contact or through audible response, that all employees are out of the fell pattern before starting the back cut.
