Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees Among other methods, one feasible and acceptable abatement method to correct these hazards is to perform maintenance and conduct and record inspections and tests on the vehicle-mounted elevating and rotating aerial ladder in accordance with American National Standard Institute, Vehicle-Mounted Elevating and Rotating Aerial Devices, Standard A92.2-1990, Section 8 for owners and users, as stipulated below: 1.Ensuring the following tests and inspections are performed by the operator once daily, prior to first use: A.Operating controls and associated mechanisms for conditions interfering with proper operation B.Visual and audible safety devices for malfunction C.Hydraulic or pneumatic systems for observable deterioration or excessive leakage D.Fiberglass and other insulating components for visible damage or contamination E.Missing or illegible operational markings F.Electrical apparatus for malfunction, signs of excessive deterioration, dirt and moisture accumulation. 2.Any suspected items shall be carefully examined and determination made by a qualified person as to whether they constitute a safety hazard. All unsafe items shall be replaced or repaired before use.
