Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to crushed-by and drowning hazards: At Greenleaf Nursery Company, employee(s) operated New Holland Tractors. The employer did not ensure functional seat belts were available on all tractor(s) equipped with Roll-over Protection System (ROPS), such as, but not limited to: a.New Holland Tractor TC29S, Unit #567, and b.New Holland Tractor TC29D A feasible means of abatement of this hazard include, but not limited to, the following: 1.Ensure seat belts are installed on all tractors with ROPS. 2.Ensure operators always wear the seat belt and fully extend the Roll-over Protection system during operation in accordance with the New Holland TC29 Operator's Manual. 3.Establish and implement a review with the tractor operators: the manufacturers operating manual safety warnings, the importance of how seat belts and ROPS function together, the importance of staying buckled in the operators seat during a roll over situation with adverse conditions and loads, to slow down before turning. 4.Ensure operators are trained and skilled in safe work practices. 5.Establish and implement unannounced safety audits to ensure operators are following the established safe practices. 6.Establish and enforce a progressive disciplinary policy for employees who fail to follow established safe work practices.
