Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to severe laceration hazards: A.On the Gledhill Nursery, Inc. Grounds: On or about April 8, 2010, an employee operating a powered hedge trimmer was not provided safety chaps during ground operations. B.In the Gledhill Nursery, Inc. Storage Area: On or about November 12, 2010, an employee operating a Husqvarna 359 chain saw was not provided safety chaps during ground operations. Note: One feasible and acceptable abatement method, among others, to correct this hazard is to provide safety chaps or trousers for employee use as required by ANSI Z133.1, Tree Care Operations - Pruning, Trimming, Repairing, and Removing Trees, and Cutting Brush Safety Requirements, Section 4.2.7: Chain saw resistant leg protection shall be worn while operating a chain saw during ground operations.
