Text For Citation: 01 Item/Group: 001 Hazard: DUST&FUMES
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potential fire and explosion because air material separators (cyclone) was not designed to minimize damage that would occur in the event of a dust explosion inside: a)warehouse beam saw area- where the Aget Dustkop cyclone at a total volume of 17.78 ft3 was located and used inside the building and did not meet the protection, venting or size requirements for inside use, on or about 7/1/2010. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with the National Fire Protection Association (NFPA), "Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids" (2006), including but not limited to; relocating the cyclone to the outside of the building, or installing safety features that meet the protection, venting and size requirements referred to within chapter 7.apter
