Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed collapse due to overloading of the balconies with CMU blocks used to construct the parapet wall. Location: 701 Union St. Brooklyn, NY a)The employer failed to follow the architectural plan specifications that required that all rear balcony parapet wall returns be made of railings. Instead, the employees erected the 2nd floor balcony parapet wall returns out of 8" CMU (Concrete Masonry Unit) blocks. Among other methods, one feasible method and acceptable method to correct this hazard is to: 1) Comply with architectural plan specifications that required all rear balcony wall returns be made of railings. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
