Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall hazard. a) Construction site, 18 - 24 Bloomfield Ave., Essex Fells, NJ Employees were walking and working on damaged scaffold platform wood planks approximately 14 feet from grade. A feasible and acceptable means of abatement includes, but is not limited to the following actions: Scaffold plank must be sound and in good condition. Damaged or deteriorated equipment must not be used, according to manufacturer's guidelines for use. Violation observed on or about 4-23-10.
