Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were elevated in a personnel platform without an operator at the controls to lower or move employees. a)On or about April 8, 2011, employees were observed in a personnel platform that was on the forks or an all terrain forklift and elevated to a height of approximately 14 feet. There was not an operator at the controls to lower or move the employees in the event of an emergency. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, WOULD BE TO COMPLY WITH THE ASME/ANSI B56.6-2002 SAFETY STANDARDS FOR ROUGH TERRAIN FORKLIFT TRUCKS, PARA. 5.15.1 WHICH REQUIRES A TRAINED OPERATOR TO BE IN POSITION TO CONTROL THE ALL TERRAIN FORKLIFT WHILE EMPLOYEES ARE ELEVATED.
