Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment w hich are free from recognized hazards of being struck by falling equipment and m aterials which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about February 09, 2011, at 200 Eas t Commerce Drive Waco, Texas, in the Hobbs main warehouse building, Line 2, Card Room. Employees were exposed to being struck by loads lifted with a CM Shopstar 1/2 ton chain hoist. The employer has not performed frequent or periodic inspec tions on the hoist to eliminate observed hazards such as but not limited to, a b roken hook safety latch, and an unlabeled pendant control box, in accordance wit h ASME/ANSI B30.16 and the manufacturer operation manual. Among other feasible m ethods to correct the identified hazard(s): 1) Conduct frequent and periodic ins pections of the hoists in accordance with ASME/ANSI B30.16-2007 Chapter 16-2 and the manufacturers operation manual. 2) Inspect, maintain and or replace the hook and or hook safety latch to ensure it meets the requirement of the manufacturer's operation manual, and ASME/ANSI B30.16.-2007 Chapter 16-1.2. 9. 3) Label or mark the pendant control box to indicate its purpose according to ASME/ANSI B30.16 Chapter 16-1.1.2. 4) Abatement certification must be submitted for this item. Pursuant to 29 CFR 1903.19, within ten (10) days, the employer m ust submit documentation and evidence showing the actions it is taking to establ ish, communicate, and implement written procedures for frequent and periodic ins pections, and to ensure the hook, hook safety latch and the pendant control box are installed and used according to the ASME/ANSI B30.16 and manufacturer's oper ations manual.
