Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Scully Welding Supply Corporation/309 Oak Avenue - The employer did not provide formal training for his employee who was assigned to fill the liquid propane tanks that were identified in the size from six to twenty pounds. This has been identified in the 2008 National Fire Protection Association [NFPA] standard; Section 4.4.4. This was observed on September 3, 2010. b)Scully Welding Supply Corporation/309 Oak Avenue - The employer did not have a qualified or competent person evaluating the transfer of the liquid propane that was being transferring from the 18 and 30 thousand gallon tanks used to fill the 20 gallon cylinders. This has been identified in the 2008 National Fire Protection Administration [NFPA] standard; Section 7.2.1.2. The compliance officer was informed of this on September 2, 2010. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with NFPA 58 gas code by developing and implementing operator training. A second acceptable method to correct this hazard is to ensure training is performed concerning supervision of the employee while operating the fill lines. NOTE: DOCUMENTATION OF ABATEMENT OF THIS CONDITION IS REQUIRED.
