Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to a struck by hazard while handling and moving natural stone slabs: a)On or about 2/8/10, in the outside storage area where granite slabs were moved using a Toyota forklift, serial number 10216, model number 8FGU30, employees were permitted to work in the fall shadow of the granite slab, exposing employees to a struck by hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to secure any forklift attachments to the forklift mast. b)On or about 2/8/10, in the outside storage area where granite slabs were moved using a Toyota forklift, serial number 10216, model number 8FGU30, the boom attachment and the material handling lifter were not secured to the forklift exposing the employee who manually steadied the suspended granite slab to a struck by hazard. Among other methods, one feasible and acceptable method to correct this hazard is to train the employees to stay out of the "fall shadow" and prohibit the employees from standing/walking in the fall shadow of slabs while transporting the stone with a forklift.
