Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck-by hazards. On or about 11/18/10 employees were exposed to a struck-by hazard from not wearing any high- visibility apparel to warn the on-coming traffic. A feasible and acceptable method on correcting this problem would be for the employer to follow and enforce the MUTCD manual's recommendations, Section 6D.03, Worker Safety Consideration, Sub. Para. B-Worker Safety Apparel - States that all workers exposed to the risks of moving roadway traffic or construction equipment should wear high visibility safety apparel meeting the requirements of ISEA "American National Standard for High-Visibility Safety Apparel" (Section 1A.11). No abatement certification or documentation is required for this item.
