Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: caught between hazards, while working in and around a conveyor system at an asphalt plant, which does not have emergency stop devices installed. On or about 07/22/10 at 329 Smith Road, Byron, GA: Employees were exposed to caught between hazards, while performing work at an asphalt plant. The employer failed to ensure that the conveyor system was protected by an emergency stop devices. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS: The employer shall comply with the provisions of ANSI B20.1-2009 Safety Standard for Conveyors and Related Equipment. In accordance with chapter 5, paragraph 5.11.2(c) "conveyors, where operator stations are not manned or are beyond voice or visual contact from drive areas, loading areas, transfer points, and other potentially hazardous locations on the conveyor path not guarded by location, position, or guards shall be furnished with emergency stop buttons, pull cords, limit switches, or similar emergency stop devices."
