Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushed-by hazards: On or about August 31, 2011, and at times prior thereto, employees were exposed to struck- by and/or crushed-by hazards while operating Toyota forklift trucks serial numbers 15427, 15436, 15331, 15411, 15431 and Mitsubishi forklift truck serial numbers AF82D00394 without seat belts. Other ID numbers are as follows: a) Toyota forklift truck # 0784597 serial #15431 b) Toyota forklift truck # 0784487 serial #15411 c) Toyota forklift truck # 0784627 serial #15436 d) Toyota forklift truck # 0784577 serial #15427 e) Toyota forklift truck # 0784133 serial #15331 f) Mitsubishi forklift truck serial # AF82D00394 One feasible method to correct the hazard includes, but is not limited to, installing a seat belt on the forklift and enforcing the use of the seat belt while operating the forklift.
