Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of their employees employment and a place of employment which are free from the recognized hazards of being struck-by and/or crushed-by falling pipes/racks which are causing or likely to cause death or serious physical harm to employees: This violation occurred on or about June 30, 2011, where employees were exposed to struck- by and/or crushed-by hazards from a pipe storage rack that was not anchored. Among the feasible method to correct the hazard includes, but not limited to: Follow MH16:2008, ANSI-RMI Specification for Design, Testing and Utilization of Industrial Steel Storage Racks, Section 1.4.7, which specifies that all rack columns shall be anchored with anchor bolts capable of resisting forces by the horizontal and vertical loads on the rack. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that employees are protected from struck by falling and/or collapsing pipe racks.sing
